A new federal rule will take a whole category of sleep gummies off the shelves. Here is what it means for yours.
What the rule says, why almost nobody noticed it, and what people who rely on these gummies can still do while they are available.
If the sleep gummy on your nightstand is not melatonin, you probably have not heard this yet.
Last November, Congress rewrote the federal definition of the plant extract these gummies are made from. It did not happen in a hearing about sleep, or about gummies. It happened in a few lines inside a government funding bill, the kind that passes late at night so the lights stay on.
Those few lines change what can legally be sold, and shipped, in every state. Most people who take one of these gummies to sleep have no idea. That is why we wrote this.
What actually changed
For years, these gummies were legal at the federal level as long as the active compound stayed under 0.3 percent by dry weight. That was the test. It is how plant-based sleep gummies came to be sold openly in shops and online across the country.
The new rule throws out the percentage. In its place is a hard cap: no more than 0.4 milligrams of the active compound in the whole container. Not per gummy. Per container.
A typical gummy in this category contains several milligrams per serving. So a single gummy can hold more than the new limit allows for an entire jar. Industry groups estimate that roughly 95 percent of the products in this category would no longer qualify under the new definition.
The rule was written to take effect this fall. Congress has already pushed the date back once, and it is now set for later this year. Once it is in force, these products can no longer be sold under the old definition, and the major carriers are expected to stop shipping them.
None of this is a rumor. It is in the text of the law, and law firms have been publishing analyses of it since spring. It just never made the evening news.

Who this actually affects
The rule is written in milligrams and definitions. In real life it lands on a fairly specific person. You might recognize yourself:

Which products does the rule cover?
Plant-based gummies, drinks and tinctures with more than 0.4 milligrams of the active compound in the container. That includes most of the sleep gummies in this category sold today, including Deep Zzzs. Products with none of the compound are not affected.
Is the date final?
Not yet. The rule was first set to take effect this fall, and Congress has already moved it back once. A further delay has been discussed, but nothing has passed. We will post the confirmed date here and email it to anyone who asks.
Does this affect melatonin or other sleep aids?
No. The rule only changes the definition of one plant extract. Melatonin, magnesium and other over-the-counter sleep aids are not part of it.
